    Update on Fishing in Pembroke Ponds

    There has been confusion on our last statement in regards to fishing in Pembroke Ponds so this Update is to clarify our intentions and provide an update on current progress.

    The Pembroke Committee ceased all catch and release fishing until we could obtain professional advice. See extract below.

    “This decision will be in place until such time that professional advice is obtained on the impact of fishing in these dams with the total Bingara water ecosystems and how to ensure the safety of children around these dams. Following this, the decision may be revisited.“

    As the Committee are not experts in this field, they thought it was prudent to stop fishing until proper advice, guidance and understanding were obtained. Unsafe acts by children and environmental issues were officially brought to the Committees’ attention so prompt action was required to ensure the safety of children and for the minimization of litigation risk.

    It has always been the intention of the Pembroke Committee to obtain professional advice and make informed decisions from this information. We will do what we can to re-open the fishing catch & release process if the Professional advice supports this outcome.

    The committee has already contacted and or researched Lendlease development, the DPI (Dept of Primary Industries), Sydney Water & WSC (Wollondilly Shire Council) seeking initial advice. Safety precautions is not covered by these official bodies and it has raised concerns in regards to the current level of insurance coverage.

    Interesting to note that Lendlease confirmed that the ponds were never designed or designated for a “catch and release system”.

    At the current time, the retention ponds are Pembroke property, even though they form a part of the entire integrated “Flooding, Stormwater and Water Quality Management for Bingara Gorge”. Thus the insurance implications to Pembroke members.

    If the professional advice suggests putting garbage bins in as a solution then the Pembroke Committee will implement that suggestion. Until the professional advice is received there is no benefit to installing garbage bins now.

    As further investigations and advice is received we will review all factors before a final decision is made.

    Notice regarding catch and release

    To Bingara Gorge Residents,

    The Pembroke Committee has been reviewing the impact of fishing in the two retention ponds near the Teas and Greens following several complaints received, and unofficial advice on the current practices of catch and release in these dams.

    The two ponds near the Teas and Greens are listed under Pembroke assets and control and are part of the total water ecosystem for Bingara Gorge which link to the other major ponds also in the Estate.

    The Pembroke committee has presented these issues to the Bingara Community Association seeking support and a co-ordinated approach to these ponds.

    Whilst the Pembroke Committee have attempted to review alternative options, it has been agreed that catch and release in any of the retention ponds within Pembroke is to cease immediately.

    This decision will be in place until such time that professional advice is obtained on the impact of fishing in these dams with the total Bingara water ecosystems and how to ensure the safety of children around these dams. Following this, the decision may be revisited.

    There were a several concerns the Pembroke Committee had to consider before making a decision, including but not limited to:

    • Overall safety of those involved
    • Overall environmental concerns
    • Unacceptable behaviour towards Security guards who have been armed with ensuring by-laws and subsequent rules are complied with
    • Environmental pollution of both the path areas and the pond which can destroy the pond ecosystem
    • Unnecessary number of fish killed due to incorrect compliance with the Dept of Fisheries advice on how to manage and implement catch and release. Note current fish population will not breed in our ponds and population is dwindling.
    • Very young unsupervised children climbing onto the other side of the fence
    • Children at risk jumping on rocks in the pond and playing in areas where snakes live
    • Destruction of trees owned by Pembroke members

    Pembroke Committee felt it was a shame to cease catch and release to the ponds however given the above-mentioned concerns also felt there was no choice but to cease this action immediately.

    Signs will be installed in the area, and security will be instructed to ensure no one is permitted to fish until further notice. We ask that residents be respectful of this decision and ensure the security team are treated with respect and understanding that they are performing their duties as instructed.

    Reminder: By-law compliance and breach management.

    Clublinks management of Bingara Gorge includes managing the by-law compliance and breach management. You would have noticed various reminders in Bingara Living, social media and now on your portal. Our current by-law focus is lot maintenance and parking including towable items, parking on nature strips etc. Initially lot owners will receive a letter indicating the breach that is applicable to them and have 14days to rectify, if breach remains additional notices will be served. Full breach process can be obtained from the Communities team.

    The security team will be assisting the Communities team with identifying these breaches and reporting to the team as they are the ones out on the road 24/7. We kindly request that you respect that they are following instructions as per their contract, and refrain from abusing them whilst they are out and about. They, like anyone deserve to work in a safe and harrasment free environment.

    REMINDER VELOCITY TRANSITION IN BINGARA GORGE – only applicable if connected to the Telstra Velocity network

    INFORMATION REGARDING THE UPCOMING TELSTRA VELOCITY NETWORK TRANSITION TO THE OPTICOMM NETWORK.

    "The legacy Telstra Velocity network is being disconnected, an order for enhanced services over the Opticomm network is required to stay connected. Without an order, once your address is transitioned you will no longer be able to access internet/phone/TV services (if your phone and TV services run over your broadband connection)."

    If you are currently connected to Telstra Velocity for your home internet, phone and free to air tv services, transition is currently scheduled to commence from 24/01/2024 to 30/01/2024 and ready for order from 13/11/2023.

    Opticomm advises the following: "The most important thing to do when your area is ready for order is to contact a phone and internet provider offering plans powered by Opticomm, we recommend that you do this no less than one week ahead of 24/01/2024 to avoid disruption to your services.
    Even if you choose to stay with your current phone and internet provider, you’ll still need to place an order for new services."

    The positives of the transition are access to a choice of providers and access to higher speeds!

    Changes to Community Land Management Act

    Dear Owners,

    As you may be aware from information circulated recently, as of December 1, 2021, the Community Land Management Act 1989 has been replaced with the Community Land Management Act 2021. Clublinks hosted Information Sessions recently regarding these changes. We have now uploaded this presentation to the MyCommunity Portal, alternatively you can request an email copy from us by emailing the Communities Team – communities@bingara.net.au. We encourage all owners to have a look at this document for an overview of the changes.

    A part of this reform means that the Executive Committee nominated at the recent Special General Meetings for all Precinct's (excluding DP280014 "Fairways") will cease until new committees can be formed at the First Annual General Meeting, please refer to Part 3, Division 1 35 (3) of the Community Land Management Act 2021. Further information on the First Annual General Meeting can be found in this presentation, including more information on the future Committees. The included attachment will show a representation of how all precinct and association committees will function and operate post the FAGM’s in 2022 while also explaining the process that needs to be undertaken to formally elect a new association committee.

    Clublinks have been circulating information via the weekly emails, and will continue to provide information in the coming weeks regarding specific topics contained in the presentation. Information will be provided through various channels (i.e. social media, owners portal, weekly email, notice board, local shops). We encourage owners to contact us with any questions.
